SUBJECT:  Resolution to Appropriate State Motor Fuel Tax Funds to Pay the City’s Portion for the Improvement of U.S. 51 from its Intersection with Pershing Road (IL 121) North to its Intersection with Interstate 72 by municipality under the Illinois Highway Code

SUMMARY RECOMMENDATION:  It is recommended that the City Council adopt the attached two Resolutions and related Ordinance described below all related to the same road project. This is a different project than the ongoing discussion with IDOT over U.S. 51 from Pershing to Eldorado.   The following items are all related to the improvement of U.S. 51 from Pershing Road (IL 121) North to its intersection with Interstate 72:

1. Resolution appropriating $7,200 in State Motor Fuel Tax Funds to pay for the traffic signal and ADA curb ramp work outlined in the City-State Agreement.

2. Ordinance regulating encroachments on the public right-of-way within the project limits.  This ordinance is Exhibit D in the City-State Agreement.

3. Resolution authorizing an agreement with the State of Illinois for improvements to U.S. 51 from its intersection with Pershing Road (IL 121) North to its intersection with Interstate 72.  The Agreement is for $7,200.  This Resolution is Exhibit A in the City-State Agreement.  
BACKGROUND:  

Business U.S. 51 Pavement Improvement

 
In 2020, the City was informed by the Illinois Department of Transportation (IDOT) of their intention to complete a major street improvement along U.S. 51 between Pershing Road to Interstate 72. The work is to include ADA sidewalk improvements, pedestrian signal improvements, bridge joint replacements and milling off the existing pavement and overlaying the road with new asphalt.  

City-State Agreement

 
The City - State Agreement includes the following items:

1. Clauses 3 and 4 state that the City will pass a resolution appropriating sufficient funds for the project.  This estimated cost is identified as $5,750 with a provision to provide the additional funds necessary to cover the actual costs.  IDOT policy limits costs relating to traffic signals to not exceed 125% of the estimated costs.  The City proposes to use $7,200 in State Motor Fuel Tax funds to pay for its share of the traffic signal and ADA curb ramps. 

2. Clause 5 relates to the City’s requirement for no parking on U.S. 36.  This was enacted in 1971 and 2000 by the City.

3. Clause 6 relates to the storm water ordinance put in place by the City to prohibit the discharge of sanitary waste in the storm sewer system.  

4. Clause 7 requires an ordinance regulating encroachments on the public right-of-way 

5. Clause 9 through Clause 11 relates to utilities in the right-of-way and utility relocation requirements.  There are no utility relocations expected on this project.

6. Clause 12 through Clause 14 outline the maintenance responsibilities of the City and the State for the roadway and other items within the right of way, including storm sewers, sidewalks and traffic signals.  This language is similar to previous City-State agreements entered into for U.S. 51.

The preliminary plans are on file at the Public Works Department.  The final plans will be provided and approved by the Public Works Department prior to bidding by the State.

BUDGET/TIME IMPLICATIONS:  

Budget Operating Funds:  Funding for the proposed project will be $7,200 from State MFT funds.  

 

Staffing Impact:  The Illinois Department of Transportation will manage this project.  There will be limited City staff involvement.
